Wills and Probate

Most people have a basic understanding of wills, which allow you to leave any assets you’ve accumulated during your lifetime to those of your choosing, such as your loved ones, friends, or a special charity.  These assets can include cash, property, and items of personal value.  A will can also be used to name a guardian for minor children, as well as an executor of the will itself.  The executor is the person responsible for making sure the will is carried out as you instructed.  

Probate is a court-related process to administer the terms of your estate.  At worst, this can be a procedure riddled with disputes and conflicting parties. Living Wills and Powers of Attorney

Living Wills are also known as Advance Directives.  They are documents that let other parties know what your wishes are, medically, if you are unable to make your own decisions anymore.  For instance, if you become ill to the point where you can no longer verbalize your wishes, a Living Will can dictate whether you want to be placed on a respirator, feeding tube, or have other life-sustaining procedures performed if necessary.  You can also decline to have such procedures initiated, or stopped after a certain point.  Lastly, you can designate those you trust to make such decisions for you.

Powers of Attorney, on the other hand, let you designate specific parties to make decisions regarding your medical or financial affairs should you become unable to do so.  You can create a medical or financial Power of Attorney, or do both at the same time.  A Power of Attorney is essentially able to handle your affairs as if he/she were you, acting on your behalf and in your best interest.  You can also name a secondary person or persons to fulfill this role if the first person you select is unwilling or becomes unable to do so.
